MFDS cosmetics regulations in Korea
In Korea, cosmetics are regulated by the Ministry of Food and Drug Safety (MFDS) under the Cosmetics Act. Businesses involved in cosmetics generally fall into defined roles, most importantly the cosmetic manufacturer, which produces the product, and the cosmetic responsible seller, which places the product on the market and carries responsibility for its quality and safety management. Each role has its own registration and obligations, and a brand may hold the responsible seller role itself or work with a company that does.
Korean labels must include specified information in Korean, such as the product name, the responsible seller's details, ingredients, net content, usage precautions, and batch and expiry information. Advertising is also regulated, and claims that suggest a medical effect can be a problem even for well-formulated products. Because details and interpretations change, we always recommend confirming final labels and claims with qualified regulatory professionals.
Functional cosmetics in Korea
Korea has a category called functional cosmetics, which covers products intended to deliver certain effects, including skin brightening, wrinkle improvement, and protection from ultraviolet rays, along with several other categories defined by MFDS. A product making such a claim generally needs to go through MFDS review or a reporting procedure before sale, depending on whether it uses ingredients and levels that MFDS has already established for that function.
This affects development. If you want to say a cream improves wrinkles, the formula usually needs a recognized active, such as adenosine or certain retinoids, at an accepted level, or supporting data. Brightening claims are often linked to recognized ingredients such as niacinamide or alpha-arbutin. Planning this at the brief stage, as part of product development, avoids reformulating later. Note that a functional cosmetic claim in Korea does not carry over to other markets; the same sunscreen, for example, is an OTC drug in the US.
Export markets: US, EU, UK, and China in general terms
United States: cosmetics fall under the FDA, with obligations under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA), including facility registration, product listing, safety substantiation, and serious adverse event reporting. Sunscreens and some other products are OTC drugs. Our US market entry page covers this in more detail.
European Union: products need an EU-based Responsible Person, a product information file including a cosmetic product safety report, and notification through the Cosmetic Products Notification Portal (CPNP) before sale. The EU also maintains detailed lists of prohibited and restricted ingredients and UV filters. United Kingdom: since leaving the EU, the UK has its own system, with a UK Responsible Person and notification through the UK's own portal.
China: cosmetics for China are overseen by the National Medical Products Administration (NMPA), with a filing route for general cosmetics and a registration route for special cosmetics such as sunscreens and whitening products, and a domestic responsible person is required for imported products. Requirements around safety assessment and testing have changed in recent years, so current rules should be checked before planning. In every market, regulations change regularly, and final decisions should be confirmed with qualified regulatory and legal professionals. We do not guarantee approval or acceptance by any authority.
Frequently Asked Questions
What is a functional cosmetic in Korea?
It is an MFDS category for products intended for specific effects such as brightening, wrinkle improvement, or UV protection, among others. These products generally go through MFDS review or reporting before sale. Requirements should be confirmed for each product.
Do I need to register a company in Korea to sell cosmetics there?
Products sold in Korea need a registered responsible seller, and production must take place at a registered manufacturer. A foreign brand can work with a Korean company that holds the responsible seller role. Confirm the right structure with a qualified adviser.
Does MFDS compliance cover export markets?
No. Each market has its own rules on ingredients, labeling, product categories, and notification. Korean compliance is a good foundation, but every target market needs its own review.
Can you file regulatory submissions for us?
We help prepare information and coordinate the process. Formal filings that must be made by a local responsible person, agent, or licensed specialist are handled by those parties, and we help you find the role you need.
